First off, don’t worry—it’s not illegal to have sex in a car in Washington State.
So as long as you are over 16 and both parties are consenting, go ahead and get your groove on but you are also not free and clear to do whatever you want as well – there is a downside if you get caught in the car out in public and not just some abandoned dirt road outside of the Tri-Cities.
The Bad News Of Getting “Frisky” In Washington State
That being said, having sex in a car isn’t exactly legal either.
According to Washington State Law, RCW 9A.88.01 states engaging in sexual activities in public is considered “public indecency.”
This means that although it isn’t strictly illegal to have sex in a car, you may be charged with public indecency if found by police officers or other members of the public.
If convicted of this crime, which could carry up to 90 days behind bars and/or fines up to $1,000 dollars depending on the severity of the case.
It’s also important to note that if either party involved has been drinking or using drugs before engaging in sexual activities there may be additional charges related to driving under the influence or drug possession.
So while getting “busy” in a car isn’t explicitly illegal in Washington State—it’s still risky business – thanks Tom Cruise – whether or not you decide it’s worth it is ultimately up to you—but just make sure you know what you’re getting yourself into before hopping into your vehicle for some summer lovin’
